Criminal Defense Representation

Criminal defense is the art of representing a client against the government from allegations of criminal conduct. The primary objective is to maintain the client’s freedom. When that objective cannot be accomplished, the objective shifts to minimizing the consequences of a criminal prosecution such as incarceration, fine, or loss of other constitutional rights and privileges, such as the right to vote or the right to keep and bear arms.

Since 2003, I have represented hundreds of clients in criminal defense cases at all levels of the New Mexico criminal justice system. If you can think of a crime, I have more than likely defended someone for it. Murder, violent crimes like assault and battery, drug trafficking and drug possession, sex crimes, white collar crimes like embezzlement, tax evasion and fraud, burglary, domestic violence, DWI and other traffic offenses. I have substantial experience practicing criminal defense in federal court, having been a member of the Criminal Justice Act (CJA) Panel for the District of New Mexico, for complex and general felony cases. The CJA Panel is a select group of attorneys appointed by the court to represent indigent defendants, which is more than 90% of all defendants in the federal court system.

A good criminal defense attorney is your best ally when your life and freedom are at stake! The prosecution always has more resources than the defense in a criminal prosecution. Law enforcement officers are trained witnesses that often do all they can, even lie, to ensure that the client gets convicted. The prosecution can pay for expert witnesses to persuasively testify about the client’s guilt. However, good criminal defense attorneys are often able to use the government’s strengths to the client’s advantage.

While I have been practicing mostly in federal court recently, most of my early legal career was spent in New Mexico state courts. I have handled criminal defense cases across the entire state. I am familiar with most of the local judges and prosecutors, especially in Las Cruces and the rest of Dona Ana County.
